The Criminal Code currently recognises the criminal liability of legal persons. In short, this new figure of the legal system determines that if a company commits a crime that could benefit it, it is criminally liable for it and therefore also the administrator, even if he knows nothing about it. In short: the company and the administrator can be criminally convicted of a crime committed, for example, by a worker.

Criminal compliance is a crime prevention plan that, once implemented in a company, allows it to prove its commitment to compliance with criminal laws and also avoid any possible criminal liability of the legal entity.

Given the possibility of criminal commission by a legal entity – as the example in the first paragraph – and the harsh penalties provided for by law (dissolution of the company, suspension of activities and astronomical fines), criminal compliance plans are now absolutely necessary for companies, not only to legally shield the organization, but also because it is understood that companies that undergo these prevention programs are committed to good practices and ethics. an added value for customers and society in general.
