Can you ask for a higher deposit for having pets in the rental contract?

Owners can ask for more than the legally required deposit for having animals or for any other reason.

According to article 36 of the Urban Leases Act, the deposit, in the case of a main residence, can be a maximum of one month’s amount of the agreed rental income. Allowing the owner to request the extra months they consider.

The deposit is a legal and mandatory guarantee that the Urban Leases Law recognizes to owners and is intended to cover possible non-payments or damages that the tenant may generate in the rented property. As the owner has the obligation to deposit the deposit in an official body that varies according to each Autonomous Community, in the case of Catalonia, the deposit must be deposited with the Catalan Land Institute.
