We inform you that the Government has approved the extension of the leave for birth and care of minors. Below, we summarize the most relevant changes:
Main new features:
- Paid leave goes from 16 to 19 weeks for each of the parents.
- Single-parent families: the leave is extended to 32 weeks.
- Retroactive application: for births, adoptions, guardianships or foster care from 2 August 2024.
- The leave is non-transferable between parents.
Distribution of leave:
- First 6 weeks:
- Compulsory and followed after birth or adoption.
- Full-time.
- From week 7 to 17:
- They can be enjoyed flexibly during the first year after birth or adoption.
- Week 18 and 19
- They can be enjoyed flexibly until the child is 8 years old.
💡 Single-parent families will have 2 additional weeks for the first year and 2 more flexible weeks up to 8 years old.
Who can apply?
Any biological or adoptive parent, guardian for the purpose of adoption or permanent or pre-adoptive foster parent:
- Employed person
- Autonomous
- Public employee
