The High Court of Justice of the European Union has annulled the requirements for parents to be able to receive the maternity supplement (now called the gender gap supplement).
Therefore, from now on, retired fathers from 2016 onwards can apply for the maternity supplement or the gender gap supplement. Here’s how it works:
- Who is entitled to it?
- People retired between 1 January 2016 and 3 February 2021:
- If you have 2 children: 5% of the pension
- If you have 3 children: 10% of the pension
- If you have 4 or more children: 15% of the pension
- It does not apply to voluntary early retirement or partial retirement.
- People retired from 4 February 2021 to the present:
- €35.90 per month for each child, up to a maximum of 4 children.
- People retired between 1 January 2016 and 3 February 2021:
- Other issues:
- It can only be collected by one of the two parents.
- It will be received by whoever has the lowest pension.
- If both receive the same amount, whoever asks for it first.
- It can be transferred: if it is received first by one parent and then the other retires, it can continue to be received by the other. Never at the same time.
Therefore, if you are a father or mother and you have retired from 2016 onwards, we recommend that you get advice on whether you meet the requirements and process the application.
