style=\"--awb-text-color:#747474;\"><p>La Generalitat de Catalu\u00f1a ha publicado hoy las medidas que se hab\u00edan anunciado referentes al alquiler de locales de negocio y establecimientos del sector de la hosteler\u00eda y del comercio al menor, afectados por el cierre o por las limitaciones de aforo.<\/p>\n<\/div><\/div><\/div><\/div><\/div><div class=\"fusion-fullwidth fullwidth-box style=\"--awb-text-color:#ffffff;\"><p><strong>En que consiste la medida?<\/strong><\/p>\n<p>Se insta a los inquilinos de los locales a intentar llegar a un acuerdo con los propietarios de los mismos, que modifique el contrato existente debido a las condiciones actuales de cierre o limitaci\u00f3n derivadas de la pandemia del Covid-19.<\/p>\n<\/div><\/div><\/div><\/div><\/div><div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-3 fusion-flex-container nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\" class=\"textarea-desti col-xs-12 col-sm-6\">\n<div class=\"form-control second-textarea\">\n<p><strong>En que consiste la medida?<\/strong><\/p>\n<p><strong>Y que pasa si no se llega a ning\u00fan acuerdo?<\/strong><\/p>\n<p>En caso de no haber llegado a ning\u00fan acuerdo en el plazo de 1 mes desde la comunicaci\u00f3n del inquilino al propietario, se pueden dar dos resoluciones seg\u00fan qu\u00e9 sea la circunstancia del local:<\/p>\n<\/div>\n<div><\/div>\n<ul>\n<li class=\"form-control second-textarea\"><strong><u>En caso de suspensi\u00f3n de la actividad (bares, restaurantes, bingos, centros de est\u00e9tica, etc.):<\/u><\/strong>\n<ul>\n<li class=\"form-control second-textarea\">Seg\u00fan las restricciones actuales, esta medida afecta a bares y restaurantes, independientemente de que puedan hacer servicio a domicilio o de recogida de productos al establecimiento.<\/li>\n<li class=\"form-control second-textarea\">Mientras dure la suspensi\u00f3n de la actividad, el alquiler del local o establecimiento se tiene que reducir en un 50%.<\/li>\n<li class=\"form-control second-textarea\">En caso de que las restricciones de suspensi\u00f3n tengan una duraci\u00f3n superior a 3 meses en el transcurso de un a\u00f1o (a contar a partir de la aplicaci\u00f3n de este decreto ley), el inquilino podr\u00e1 rescindir el contrato sin penalizaciones.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li><strong><u>En cas o de restricci\u00f3n parcial de la actividad (empresas de servicios, comercios al menor, etc.):<\/u><\/strong><br \/>\nSeg\u00fan las restricciones actuales, esta medida afecta a establecimientos y locales de comercio al menor, que est\u00e9n afectados por la restricci\u00f3n de aforo.<br \/>\nMientras dure la restricci\u00f3n, el alquiler del local se tiene que reducir proporcionalmente a la medida y, sobre la parte de la cual no se puede disponer del local, aplicar un 50% de reducci\u00f3n.<br \/>\nEjemplos:<br \/>\nEn caso de tener un aforo m\u00e1ximo del 30% (en los metros cuadrados de atenci\u00f3n al p\u00fablico, excluidos los almacenes), habr\u00e1 que reducir el alquiler del local o establecimiento en un 50% sobre el 70% del cual no se dispone, y por tanto, reducir un 35% del alquiler de la parte del local de atenci\u00f3n al p\u00fablico.<br \/>\nEn caso de se una tienda 24 horas y tener una limitaci\u00f3n de horario (cierre entre las\u00a022h\u00a0y las\u00a07h), habr\u00e1 que reducir el alquiler del local o establecimiento en un 50% sobre el 37,5% del cual no se puede disponer (las\u00a09h\u00a0de cierre sobre las\u00a024h\u00a0del d\u00eda), y por tanto, reducir un 18,75% del alquiler de la parte del local de atenci\u00f3n al p\u00fablico.Desde el momento en que el propietario haya recibido un requerimiento fehaciente (habitualmente burofax) por parte del inquilino de la voluntad de negociaci\u00f3n, no podr\u00e1 emitir ninguna factura o recibo de alquiler hasta que no se haya llegado un acuerdo o, en caso de no acuerdo y en el jefe de un mes, se apliquen las reducciones anteriores.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/form>\n<\/section>\n<\/div><\/div><\/div><\/div><\/div><div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-4 fusion-flex-container nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"--awb-text-color:#ffffff;\"><p><strong>Y si hab\u00eda una fianza superior a la m\u00ednima legal?<\/strong><\/p>\n<p>En este caso, el pago del alquiler del local o establecimiento, aplicando las medidas anteriores, podr\u00e1 ir a cargo de esta fianza, no pudiendo ser esta inferior a la fianza marcada por ley, teni\u00e9ndose que reintegrar como m\u00e1ximo en 1
