align=\"justify\">A continuaci\u00f3n se exponen qu\u00e9 tipolog\u00edas de despido hay vigentes en el ordenamiento jur\u00eddico (disciplinario, objetivo o colectivo) y las consecuencias, tanto para la empresa como para el trabajador, de las calificaciones de estos (procedentes, nulos o improcedentes).<\/p>\n<\/div><div class=\"fusion-image-element \" fusion-text-4\"><p>Un despido es la rescisi\u00f3n del contrato de uno o varios trabajadores \/ as, por parte de una empresa. Despido disciplinario<\/h3>\n<p>Regulado en el art\u00edculo 54 del Estatuto de los Trabajadores, este despido se basa en <strong>un incumplimiento grave de las obligaciones<\/strong> por parte del trabajador\/a teniendo en cuenta alguno de los siguientes supuestos:<\/p>\n<ul>\n<li>Faltas repetidas e injustificadas de asistencia o puntualidad al trabajo.<\/li>\n<li>Indisciplines o desobediencia.<\/li>\n<li>Ofensas verbales o f\u00edsicas al empresario o personas que trabajan en la empresa oa sus familiares.<\/li>\n<li>Abuso de confianza.<\/li>\n<li>Mermar el rendimiento del trabajo de forma continuada y voluntaria.<\/li>\n<li>Alcoholismo o toxicoman\u00eda si repercuten negativamente en el trabajo.<\/li>\n<li>Acoso por razones de raza, religi\u00f3n, discapacidad, edad u orientaci\u00f3n sexual y acoso sexual al empresario o trabajadores \/ as de la empresa.<\/li>\n<\/ul>\n<p>Cabe destacar que en este tipo de despido <strong>la empresa es la que tiene que demostrar la culpa de trabajador\/a<\/strong>. Despido objetivo<\/h3>\n<p>Regulado en el art\u00edculo 52 del Estatuto de los Trabajadores, este tipo de despido debe cumplir una serie de requisitos:<\/p>\n<ul>\n<li>Ineptitud del trabajador\/a.<\/li>\n<li>Falta de adaptaci\u00f3n del trabajador\/a a las modificaciones t\u00e9cnicas realizadas en su puesto de trabajo, siempre que los cambios sean razonables.<\/li>\n<li>Por causas econ\u00f3micas, organizativas, t\u00e9cnicas o de producci\u00f3n.<\/li>\n<li>Por falta de asistencia al trabajo, aunque sean justificadas, que sean intermitente.<\/li>\n<li>En caso de contratos indefinidos concertados por entidades sin \u00e1nimo de lucro, por insuficiencia de ingresos para el mantenimiento del puesto de trabajo.<\/li>\n<\/ul>\n<p>Cabe destacar que en este tipo de despido <strong>la empresa debe demostrar que existen razones econ\u00f3micas, t\u00e9cnicas, organizativas o de producci\u00f3n entre otros<\/strong> para poder aplicarlo.<\/p>\n<p><strong>Las consecuencias<\/strong> ante este despido es que la relaci\u00f3n laboral se extingue, <strong>el trabajador\/a recibir\u00e1 una indemnizaci\u00f3n de 20 d\u00edas por a\u00f1o trabajado con un m\u00e1ximo de 12 mensualidades<\/strong>, y el trabajador \/ a podr\u00e1 cobrar el paro si re\u00fane los requisitos necesarios.<\/p>\n<\/div><\/div><\/div><\/div><\/div><\/div><div id=\"ere\" class=\"fusion-container-anchor\"><div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-5 fusion-flex-container nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"--awb-border-radius-top-left:0px;--awb-border-radius-top-right:0px;--awb-border-radius-bottom-right:0px;--awb-border-radius-bottom-left:0px;--awb-padding-bottom:0px;--awb-border-sizes-top:0px;--awb-border-sizes-bottom:0px;--awb-flex-wrap:wrap;\" ><div class=\"fusion-builder-row fusion-row fusion-flex-align-items-flex-start fusion-flex-content-wrap\" style=\"max-width:calc( 1260px + 0px );margin-left: calc(-0px \/ 2 );margin-right: calc(-0px \/ 2 );\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-6 fusion_builder_column_1_1 1_1 fusion-flex-column\" style=\"--awb-bg-size:cover;--awb-width-large:100%;--awb-margin-top-large:20px;--awb-spacing-right-large:0px;--awb-margin-bottom-large:20px;--awb-spacing-left-large:0px;--awb-width-medium:100%;--awb-spacing-right-medium:0px;--awb-spacing-left-medium:0px;--awb-width-small:100%;--awb-spacing-right-small:0px;--awb-spacing-left-small:0px;\"><div class=\"fusion-column-wrapper fusion-column-has-shadow fusion-flex-justify-content-flex-start fusion-content-layout-column\"><div class=\"fusion-text fusion-text-7\"><h3 style=\"padding-left: 80px;\">1. Despido colectivo (ERE)<\/h3>\n<p>Este tipo de despido se basa en unas causas econ\u00f3micas, t\u00e9cnicas, organizativas o de producci\u00f3n que se pase a lo largo de <strong>90 d\u00edas<\/strong> y que afectivo a:<\/p>\n<ul>\n<li>A 10 trabajadores\/as, en empresas con menos de 100 trabajadores\/as.<\/li>\n<li>El 10% del n\u00famero de trabajadores\/as de la empresa en aquellas que tienen entre 100 y 300 trabajadores\/as.<\/li>\n<li>30 trabajadores\/as en las empresas que tienen m\u00e1s de 300 trabajadores\/as.<\/li>\n<\/ul>\n<p>La <strong>consecuencia<\/strong> es la p\u00e9rdida del puesto de trabajo pero con la necesidad de incorporar al acuerdo diferentes tipos de medidas como acciones de formaci\u00f3n, reciclaje profesional que permitan conseguir, en un tiempo reducido, un nuevo puesto de trabajo a los trabajadores\/as afectados . De igual manera que en el despido objetivo, <strong>el trabajador\/a recibir\u00e1 una indemnizaci\u00f3n de 20 d\u00edas por a\u00f1o trabajado con un m\u00e1ximo de 12 mensualidades<\/strong>.<\/p>\n<\/div><\/div><\/div><\/div><\/div><\/div><div id=\"procedente\" class=\"fusion-container-anchor\"><div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-6 fusion-flex-container nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"--awb-border-radius-top-left:0px;--awb-border-radius-top-right:0px;--awb-border-radius-bottom-right:0px;--awb-border-radius-bottom-left:0px;--awb-padding-bottom:0px;--awb-border-sizes-top:0px;--awb-border-sizes-bottom:0px;--awb-flex-wrap:wrap;\" ><div class=\"fusion-builder-row fusion-row fusion-flex-align-items-flex-start fusion-flex-content-wrap\" style=\"max-width:calc( 1260px + 0px );margin-left: calc(-0px \/ 2 );margin-right: calc(-0px \/ 2 );\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-7 fusion_builder_column_1_1 1_1 fusion-flex-column\" style=\"--awb-bg-size:cover;--awb-width-large:100%;--awb-margin-top-large:20px;--awb-spacing-right-large:0px;--awb-margin-bottom-large:20px;--awb-spacing-left-large:0px;--awb-width-medium:100%;--awb-spacing-right-medium:0px;--awb-spacing-left-medium:0px;--awb-width-small:100%;--awb-spacing-right-small:0px;--awb-spacing-left-small:0px;\"><div class=\"fusion-column-wrapper fusion-column-has-shadow fusion-flex-justify-content-flex-start fusion-content-layout-column\"><div class=\"fusion-title title fusion-title-3 fusion-sep-none fusion-title-text fusion-title-size-two\" style=\"--awb-margin-top-small:10px;--awb-margin-right-small:0px;--awb-margin-bottom-small:20px;--awb-margin-left-small:0px;\"><h2 class=\"fusion-title-heading title-heading-left\" style=\"margin:0;\"><span style=\"text-decoration: underline;\">\u00bfY como se califican cada uno de los despidos?<\/span><\/h2><\/div><div class=\"fusion-text fusion-text-8\"><p>Aparte de los tipos de despidos anteriores, este hay que calificarlos en 3 tipos (que en caso de reclamaci\u00f3n judicial, ser\u00e1 el juez o jueza quien lo determine):<\/p>\n<\/div><div class=\"fusion-separator fusion-full-width-sep\" style=\"align-self: center;margin-left: auto;margin-right: auto;margin-top:10px;width:100%;\"><\/div><div class=\"fusion-text fusion-text-9\"><h3 style=\"padding-left: 80px;\">1. Despido procedente<\/h3>\n<p>Esta calificaci\u00f3n de despido se refiere cuando se determina como correcto el tipo de despido que se ha realizado. En caso de reclamaci\u00f3n judicial, <strong>cuando el juzgado ha dictaminado que su despido es correcto<\/strong> se llama despido procedente.<br \/>\nEn caso de que el <strong>despido disciplinario<\/strong> sea determinado como procedente, no se produce <strong>ning\u00fan tipo de indemnizaci\u00f3n<\/strong>. Despido improcedente<\/h3>\n<p>Esta calificaci\u00f3n de despido hace referencia a cuando se determina que las causas del despido <strong>no re\u00fane los requisitos formales<\/strong> de la ley, o bien <strong>cuando no se acredita judicialmente que el tipo de despido aplicado procede<\/strong>.<\/p>\n<p>Las consecuencias de que un despido sea determinado como improcedente obliga a la empresa (a elecci\u00f3n de \u00e9sta) o bien a readmitir el \/ la trabajador \/ a o bien a recibir una indemnizaci\u00f3n seg\u00fan los siguientes par\u00e1metros:<\/p>\n<ul>\n<li><strong>45 d\u00edas de salario por a\u00f1o trabajado por el tiempo de trabajo hasta la fecha 11 de febrero de 2012.<\/strong><\/li>\n<li><strong>33 d\u00edas de salario por a\u00f1o trabajado por el tiempo de trabajo posterior a la fecha anterior.<\/strong><\/li>\n<\/ul>\n<p>El importe indemnizatorio resultante no podr\u00e1 ser superior a 720 d\u00edas de salario, salvo que del c\u00e1lculo de la indemnizaci\u00f3n por el periodo del primer punto anterior resultase un n\u00famero de d\u00edas superior, en cuyo caso se aplicar\u00e1 \u00e9ste como importe indemnizatorio m\u00e1ximo, sin que, en
