{"id":5798,"date":"2019-01-07T00:01:43","date_gmt":"2019-01-06T23:01:43","guid":{"rendered":"http:\/\/www.gestingral.com\/gestingral\/novetats-contractes-lloguer-5-anys-prorrogues-3-limitacio-fiances\/"},"modified":"2019-01-31T15:11:38","modified_gmt":"2019-01-31T14:11:38","slug":"novedades-contratos-alquiler-5-anos-prorrogas-3-limitacion-fianzas","status":"publish","type":"post","link":"https:\/\/www.gestingral.com\/es\/novedades-contratos-alquiler-5-anos-prorrogas-3-limitacion-fianzas\/","title":{"rendered":"Novedades: Contratos de alquiler de 5 a\u00f1os, pr\u00f3rogas de 3 y limitaci\u00f3n de fianzas"},"content":{"rendered":"<div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-1 fusion-flex-container nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"--awb-border-radius-top-left:0px;--awb-border-radius-top-right:0px;--awb-border-radius-bottom-right:0px;--awb-border-radius-bottom-left:0px;--awb-padding-top:0px;--awb-padding-right:0px;--awb-padding-left:0px;--awb-border-sizes-top:0px;--awb-border-sizes-bottom:0px;--awb-flex-wrap:wrap;\" ><div class=\"fusion-builder-row fusion-row fusion-flex-align-items-flex-start fusion-flex-content-wrap\" style=\"max-width:calc( 1260px + 0px );margin-left: calc(-0px \/ 2 );margin-right: calc(-0px \/ 2 );\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-0 fusion_builder_column_1_1 1_1 fusion-flex-column\" style=\"--awb-bg-size:cover;--awb-width-large:100%;--awb-margin-top-large:-15px;--awb-spacing-right-large:0px;--awb-margin-bottom-large:20px;--awb-spacing-left-large:0px;--awb-width-medium:100%;--awb-spacing-right-medium:0px;--awb-spacing-left-medium:0px;--awb-width-small:100%;--awb-spacing-right-small:0px;--awb-spacing-left-small:0px;\"><div class=\"fusion-column-wrapper fusion-flex-justify-content-flex-start fusion-content-layout-column\"><div class=\"fusion-text fusion-text-1\"><p style=\"font-size: 18px; line-height: 28px;\" align=\"justify\"><span style=\"color: #ff0000;\">Las condiciones explicadas a continuaci\u00f3n s\u00f3lo son v\u00e1lidas entre el 18 de diciembre de 2018 y el 23 de enero de 2019, con motivo de la derogaci\u00f3n del Real Decreto Ley por parte del Congreso, y que ha sido publicado en el<\/span>\u00a0\u00a0<a href=\"https:\/\/www.boe.es\/boe\/dias\/2019\/01\/24\/pdfs\/BOE-A-2019-799.pdf\" target=\"_blank\" rel=\"noopener\">BOE del d\u00eda 24 de enero de 2019<\/a>.<\/p>\n<\/div><div class=\"fusion-text fusion-text-2\"><p style=\"font-size: 18px; line-height: 28px;\" align=\"justify\">A ra\u00edz de la modificaci\u00f3n de la normativa referente al alquiler de vivienda, se presentan algunos cambios significativos: se ampl\u00eda la duraci\u00f3n de los contratos a 5 a\u00f1os, las pr\u00f3rrogas a 3 a\u00f1os y se limitan las fianzas a un m\u00e1ximo de 2 mensualidades, entre otros cambios.<\/p>\n<\/div><div class=\"fusion-image-element \" style=\"text-align:center;--awb-caption-title-font-family:var(--h2_typography-font-family);--awb-caption-title-font-weight:var(--h2_typography-font-weight);--awb-caption-title-font-style:var(--h2_typography-font-style);--awb-caption-title-size:var(--h2_typography-font-size);--awb-caption-title-transform:var(--h2_typography-text-transform);--awb-caption-title-line-height:var(--h2_typography-line-height);--awb-caption-title-letter-spacing:var(--h2_typography-letter-spacing);\"><span class=\" fusion-imageframe imageframe-none imageframe-1 hover-type-none fusion-animated\" style=\"border-radius:12px;\" data-animationType=\"fadeInUp\" data-animationDuration=\"0.3\" data-animationOffset=\"top-into-view\"><img decoding=\"async\" src=\"http:\/\/www.gestingral.com\/wp-content\/uploads\/2019\/01\/ES-LLOGA.jpg\" alt class=\"img-responsive\"\/><\/span><\/div><div class=\"fusion-separator fusion-full-width-sep\" style=\"align-self: center;margin-left: auto;margin-right: auto;margin-top:10px;margin-bottom:10px;width:100%;\"><\/div><div class=\"fusion-text fusion-text-3\"><p>Ante la necesidad de adaptar el marco normativo a la situaci\u00f3n actual del mercado de alquiler de la vivienda se ha llevado a cabo la publicaci\u00f3n del <strong><a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2018-17293\" target=\"_blank\" rel=\"noopener\">Real Decreto Ley 21\/2018 de 14 de diciembre<\/a>, de medidas urgentes en materia de vivienda y alquiler<\/strong>. Entre las modificaciones que afectan a los contratos de alquiler, cabe destacar las siguientes:<\/p>\n<ul>\n<li><strong>La duraci\u00f3n de los contratos ser\u00e1 m\u00e1s larga, ya que se ampl\u00eda el plazo de los 3 a los 5 a\u00f1os<\/strong> para los nuevos contratos efectuados a partir de la fecha. Adem\u00e1s, en caso de que el arrendador sea una persona jur\u00eddica, este per\u00edodo pasa a ser de 7 a\u00f1os.<\/li>\n<li><strong>Se modifica el plazo de la pr\u00f3rroga de los contratos de arrendamiento de vivienda, que pasa a ser de 3 a\u00f1os<\/strong>. Por lo tanto, al finalizar el contrato de 5 a\u00f1os explicado en el punto anterior (o 7 a\u00f1os en personas jur\u00eddicas), y siempre en el caso de que ninguna de las dos partes haya notificado al otro la voluntad de rescindir el contrato en un plazo de 30 d\u00edas, aplicar\u00e1 autom\u00e1ticamente esta pr\u00f3rroga (que hasta la fecha era de 1 a\u00f1o).<\/li>\n<li>Se limitan las garant\u00edas m\u00e1ximas adicionales a la fianza (que es de una mensualidad de renta), y se establece como <strong>garant\u00eda m\u00e1xima un m\u00e1ximo de 2 mensualidades<\/strong>.<\/li>\n<li>En caso de que <strong>el arrendador sea persona jur\u00eddica, \u00e9ste se har\u00e1 cargo de los gastos de gesti\u00f3n inmobiliaria y de formalizaci\u00f3n del contrato<\/strong>.<\/li>\n<\/ul>\n<p>Tambi\u00e9n hay <strong>modificaciones respecto del alquiler tur\u00edstico de las viviendas<\/strong>, en que se establece que una mayor\u00eda cualificada (de 4\/5 a Catalu\u00f1a y de 3\/5 partes en Espa\u00f1a) de las comunidades de vecinos, podr\u00e1n adoptar acuerdos que limiten o condicionen el ejercicio de la actividad del alquiler tur\u00edstico de la vivienda, para intentar favorecer la convivencia en los edificios que cuenten con este tipo de viviendas. Esta medida no tiene car\u00e1cter retroactivo, y s\u00f3lo afecta a los nuevos pisos tur\u00edsticos.<\/p>\n<\/div><div class=\"fusion-text fusion-text-4\"><p><a href=\".\/publicacions\"><i
