En estos casos, su duraci\u00f3n ser\u00e1 de 6 meses y, por convenio colectivo, se podr\u00e1 prorrogar 6 meses m\u00e1s.<\/li>\n<li>En el supuesto de que haya necesitados temporales PREVISIBLES, se podr\u00e1 hacer el contrato solo por un periodo de 3 meses, no consecutivos dentro del a\u00f1o natural.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li><strong>Por sustituci\u00f3n de la persona trabajadora con reserva del puesto de trabajo (antes m\u00e1s conocido por \u201cinterinidad\u201d)<\/strong>\n<ul>\n<li>Su duraci\u00f3n ser\u00e1 de todo el tiempo que exista dicha sustituci\u00f3n.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Hasta entonces, se podr\u00e1 continuar haciendo contratos temporales como se hab\u00edan hecho hasta ahora, con la novedad de que \u00fanicamente podr\u00e1n tener una duraci\u00f3n de m\u00e1ximo 6 meses.<\/p>\n<p>Por lo tanto, <u>el contrato de obra y servicio dejar\u00e1 de existir a partir a partir del 31-03-2022.<\/u><\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-5f616854c2ed6e37a fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_5f616854c2ed6e37a\"><a aria-expanded=\"false\" aria-controls=\"5f616854c2ed6e37a\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-13664-1\" data-target=\"#5f616854c2ed6e37a\" href=\"#5f616854c2ed6e37a\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\"> Encadenamientos de contrato<\/span><\/a><\/h4><\/div><div id=\"5f616854c2ed6e37a\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_5f616854c2ed6e37a\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>En caso de que un trabajador est\u00e9 contratado por la misma empresa (intermediando diferentes contratos por circunstancias de la producci\u00f3n) durando m\u00e1s de 18 meses, dentro de un periodo de 2 a\u00f1os naturales, la empresa se ver\u00e1 obligada a hacerle la conversi\u00f3n a contrato indefinido.<\/p>\n<p>Esta medida, se toma para evitar que haya aprovechamiento de las condiciones de los contratos temporales.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-30fefcdbbbd484d14 fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_30fefcdbbbd484d14\"><a aria-expanded=\"false\" aria-controls=\"30fefcdbbbd484d14\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-13664-1\" data-target=\"#30fefcdbbbd484d14\" href=\"#30fefcdbbbd484d14\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">Cotizaci\u00f3n adicional de los contratos de duraci\u00f3n determinada por circunstancias de la producci\u00f3n<\/span><\/a><\/h4><\/div><div id=\"30fefcdbbbd484d14\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_30fefcdbbbd484d14\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>Cuando los contratos por circunstancias de la producci\u00f3n sean inferiores a 30 d\u00edas, tendr\u00e1n una cotizaci\u00f3n adicional a cargo del empresario. El importe a\u00f1adido que se pagar\u00e1 en la cotizaci\u00f3n ser\u00e1 de 26,57\u20ac, por cada contrato.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-b1aa14581b904f87f fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_b1aa14581b904f87f\"><a aria-expanded=\"false\" aria-controls=\"b1aa14581b904f87f\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-13664-1\" data-target=\"#b1aa14581b904f87f\" href=\"#b1aa14581b904f87f\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">Contratos de formaci\u00f3n<\/span><\/a><\/h4><\/div><div id=\"b1aa14581b904f87f\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_b1aa14581b904f87f\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>Los principales cambios en el <u>contrato de formaci\u00f3n<\/u> son los siguientes:<\/p>\n<ul>\n<li>Pasar\u00e1 a denominarse \u201c<strong><u>contrato de formaci\u00f3n en alternancia<\/u><\/strong>\u201d.<\/li>\n<li>Tendr\u00e1 una duraci\u00f3n m\u00ednima de 3 meses y m\u00e1xima de 2 a\u00f1os.<\/li>\n<li>Se podr\u00e1 hacer a tiempo parcial y no tendr\u00e1 periodo de prueba.<\/li>\n<\/ul>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-4a3d9055bc6afdc85 fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_4a3d9055bc6afdc85\"><a aria-expanded=\"false\" aria-controls=\"4a3d9055bc6afdc85\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-13664-1\" data-target=\"#4a3d9055bc6afdc85\" href=\"#4a3d9055bc6afdc85\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">Contrato de pr\u00e1cticas<\/span><\/a><\/h4><\/div><div id=\"4a3d9055bc6afdc85\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_4a3d9055bc6afdc85\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<ul>\n<li>Pasar\u00e1 a denominarse \u201ccontrato para la pr\u00e1ctica profesional\u201d.<\/li>\n<li>Su duraci\u00f3n ser\u00e1 de 6 meses a 1 a\u00f1o.<\/li>\n<li>Se podr\u00e1 concertar con qui\u00e9n tenga estudios finalizados desde hace menos de 3 a\u00f1os (5 a\u00f1os en el caso de trabajador con discapacidad).<\/li>\n<\/ul>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-0367be18eec330875 fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_0367be18eec330875\"><a aria-expanded=\"false\" aria-controls=\"0367be18eec330875\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-13664-1\" data-target=\"#0367be18eec330875\" href=\"#0367be18eec330875\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">ERTES<\/span><\/a><\/h4><\/div><div id=\"0367be18eec330875\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_0367be18eec330875\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>A partir del 28-02-2022, se recuperar\u00e1n los ETOP con las mismas condiciones que ya se hab\u00edan aplicado antes de la pandemia. La novedad que incluir\u00e1n es que el periodo de negociaci\u00f3n se ver\u00e1 reducido en 7 d\u00edas, en caso de que la empresa tenga menos de 50 trabajadores.<\/p>\n<p>Aparte, tambi\u00e9n habr\u00e1 los ERTES por fuerza mayor. Estos permitir\u00e1n que las empresas puedan aplicar reducci\u00f3n de jornada o, si procede, suspensi\u00f3n de los contratos.<\/p>\n<p>La fuerza mayor estar\u00e1 determinada por impedimentos o limitaciones de la actividad que se puedan aprobar a partir de ahora, as\u00ed como circunstancias de fuerza mayor que no tengan nada que ver con la COVID.<\/p>\n<p>Durante la aplicaci\u00f3n de los ERTES, las empresas no podr\u00e1n realizar horas extraordinarias, ni hacer nuevas altas, ni externalizaciones de la actividad.<\/p>\n<p>Del mismo modo, las empresas que se apliquen las bonificaciones en la cotizaci\u00f3n vinculadas a los ERTES, tendr\u00e1n que mantener la ocupaci\u00f3n de aquellas personas trabajadoras durante un periodo de 6 meses, a contar desde la finalizaci\u00f3n de este.<\/p>\n<p>En caso de incumplimiento, se tendr\u00e1 que reintegrar el importe de las cotizaciones exoneradas (con el recargo e inter\u00e9s correspondiente) solo de la persona trabajadora por la cual se ha incumplido el mantenimiento.<\/p>\n<p>Aun as\u00ed, no se prev\u00e9 la reposici\u00f3n de las prestaciones de paro en los nuevos ERTES y las mismas, se regir\u00e1n por la normativa de las prestaciones (es decir, quienes no tenga paro, no cobrar\u00e1).<\/p>\n<\/div><\/div><\/div><\/div><\/div><\/div><\/div><\/div><\/div>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":16,"featured_media":13661,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[472,397,473,400],"tags":[],"class_list":["post-13664","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-empresas-es","category-empreses","category-particulares-es","category-particulars"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.6 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Reforma Laboral 2022 &#8226;
